De negende editie van de Thoolen NJCM-scriptieprijs is gewonnen door Irthe de Jong met haar scriptie ‘Climate Justice Before International Human Rights Adjudicators: why climate-related human rights cases should be approached with an intersectional lens’, geschreven aan Radboud Universiteit Nijmegen. De jury vond de link tussen klimaatverandering en intersectionaliteit in deze scriptie sterk. De scriptie bespreekt een probleem dat de komende jaren actueel zal blijven en vraagt daarbij terecht aandacht voor de rechten van de meest getroffenen. Ook was de jury te spreken over het fraaie taalgebruik in deze scriptie.

De tweede plek gaat naar Leonore ten Hulsen met haar scriptie ‘Open Sourcing Evidence from the Internet. The protection of privacy in civilian criminal investigations using OSINT (open-source intelligence)’, geschreven aan de Vrije Universiteit Amsterdam. De jury vond dit een juridisch goede scriptie met een origineel onderwerp. Er wordt een mooie koppeling gemaakt van concrete casussen aan theoretische verdieping.

De jury beoordeelde de scripties op: de originaliteit van het onderwerp, de mensenrechtelijke toepassing, het wetenschappelijk niveau, vernieuwing, bronnenonderzoek en leesbaarheid/toegankelijkheid. Het panel was onder de indruk van beide scripties, welke interessante en actuele thema’s op een goede manier weten te doorgronden.

• Mvr. mr. M.L. Haimé, gepensioneerd voormalig Directeur Constitutionele Zaken en Wetgeving (BZK) respectievelijk Directeur Inburgering en Integratie (SZW);
• Mr. dr. Jasper Krommendijk, universitair hoofddocent Internationaal en Europees Recht aan de Radboud Universiteit;
• Prof. dr. Rick Lawson, decaan Faculteit der Rechtsgeleerdheid, Universiteit Leiden;
• Prof. mr. Egbert Myjer, bijzonder hoogleraar Mensenrechten, Vrije Universiteit Amsterdam; Nederlandse rechter bij het Europees Hof voor de Rechten van de Mens in Straatsburg van 2004 tot 2012;
• Mr. Tamara Trotman, raadsheer Gerechtshof Den Haag.

De prijs(uitreiking)

De Thoolen NJCM-Scriptieprijs bestaat uit de publicatie van de winnende scriptie in boekvorm door Stichting NJCM-Boekerij. De prijsuitreiking zal plaatsvinden tijdens de Algemene Ledenvergadering. Deze datum zal in de aankomende maanden bekend worden gemaakt.

The jury has chosen Irthe de Jong as the winner of the ninth edition of the Thoolen NJCM Dissertation Prize 2021 with her dissertation on ‘Climate Justice Before International Human Rights Adjudicators: why climate-related human rights cases should be approached with an intersectional lens’, written at Radboud University Nijmegen. The jury found the link between climate change and intersectionality very interesting in her thesis. The thesis discusses a problem that will dominate in the coming years and rightly calls attention to the rights of those most affected.

The second place went to Leonore ten Hulsten with her thesis ‘Open Sourcing Evidence from the Internet. The protection of privacy in civilian criminal investigations using OSINT (open-source intelligence)’, written at Vrije Universiteit Amsterdam. The jury found this to be a legally sound thesis with an original subject. A good link is made between concrete case studies and theoretical depth.

The jury assessed the theses on: the originality of the subject, the human rights application, the scientific level, innovation, source material research and readability/accessibility. The panel was impressed by both theses, which are able to understand interesting and current themes in a good way.

The award (ceremony)

The Thoolen NJCM Thesis Prize consists of the publication of the winning thesis in book form by the NJCM-Boekerij Foundation. The award ceremony will take place during our Annual General Meeting. More information about this will follow in due course.
